General Sales Conditions

GENERAL SALES CONDITIONS

On this website, fresh and preserved food products and a selection of non-food items are sold online, respecting the Italian regulations regarding distance contracts.
Before placing an order, the Customer is requested to carefully read the sales conditions as specified above and the information contained therein and to print or save them on a long-lasting medium.
Any alterations or new sales conditions will be drawn to the Customer’s attention in good time, will come into force at the moment in which they are published on the website and will only be applied to sales concluded after their publication.
The placing of an order by the Customer signifies their acceptance of the sales conditions in force at that time.
 
CONCLUSION OF SALES CONTRACT
Orders sent by the Customer to Pestoshop sas via Internet must be complete and must include all details necessary for the identification of the Customer and the products ordered as well as indication of the delivery address. Without these the order will be invalid. Pestoshop sas will send the customer confirmation of receipt of the order by email and will include the applicable general sales conditions.
 
CHARACTERISTICS AND AVAILABILITY OF PRODUCTS
In some circumstances Pestoshop sas may not be able to guarantee availability of all the products offered and cannot be considered responsible for their temporary lack of availability. The placing of an order by the Customer signifies both their acceptance of a possible part-delivery, including only the products available within those orders, as well as the waiver of the right to ask for compensation and/or a refund. Nevertheless Pestoshop sas commits to informing the Customer in good time in the case of lack of availability of a product ordered, giving the Customer the possibility to cancel the order before the products are dispatched.

PRICES AND METHODS OF PAYMENT
The product prices given on the website include VAT. The prices charged are those which appear on the website at the time the Customer places their order. The price of individual products may change without warning. The prices published on the website invalidate and replace those previously published. The cost of the products ordered and related delivery costs must be paid at the time of ordering online, by means of the methods indicated below in the paragraph ‘Safe Payment’. Pestshop sas will consign the tax documentation on delivery of the order.

In the case of payment by bank transfer, the orders will be dispatched only after our bank has confirmed that payment has been received; you will therefore be asked to provide some details (issuing bank and CRO number).
When you make an order, we will ask you to provide a contact telephone number, so that we can contact you and confirm the details of the order.

GUARANTEES AND RESPONSIBILITY
Pestoshop sas guarantees both the delivery of the product as indicated and described on the website (within the limits explained above) and the compliance with all regulations relating to the conservation of the product until it is delivered to the address indicated on the order form. For all products, the producer is responsible for the accuracy and completeness of the information on the packaging. The pictures on the website are provided to facilitate recognition of the products and may not have exactly the same appearance as the product sold.

DISPUTES AND APPLICABLE LAW
Civil disputes related to the application, implementation and interpretation of the distance sales contract are subject to Italian jurisdiction and will come under the law court in the place of residence of the Customer, if on Italian territory. The distance contracts drawn up with Pestoshop sas are regulated by Italian law and, therefore, when not explicitly stated, the rules of law on the subject are valid.

RIGHT TO WITHDRAW
The Customer has the right to withdraw from the contract, without any penalty and without specifying the reason, at any time, upon written or oral communication sent to Pesto Shop sas.
 
To return the goods, write to info@pestoparodi.com. In the communication, the Customer must specify the product or products for which they intend to exert the right to withdraw.
 
Pestoshop sas will organise, at its own expense and care, to have the product picked up in an agreed way and within a time period already agreed with the Customer, except if it decides to forego the return of the above.

According to the Customer’s choice Pestoshop sas will replace the products with others of equal value or refund the money.
